Agreement to these terms
These Terms and Conditions form an agreement between you and Aura Himalaya ("Aura Himalaya", "we", "us"), the publisher of the Pranam app, website and developer API (together, the "Service"). By downloading, accessing or using the Service you agree to these terms. If you do not agree, please do not use the Service.
Our Privacy Policy forms part of this agreement and explains how we handle personal data.
Eligibility
You must be at least 13 years old to use Pranam, or 16 where your country requires it, and you must have the legal capacity to enter this agreement. If you use the Service on behalf of an organisation, you confirm you are authorised to bind that organisation to these terms.
Your account
- Give accurate information when you register and keep it up to date.
- Keep your password and sign-in credentials confidential; you are responsible for activity under your account.
- Accounts are personal to you — do not share, sell or transfer your account.
- Tell us at once, at the address below, if you believe your account has been used without your permission.
We may suspend or close an account that breaches these terms, is used fraudulently, or puts the Service or other users at risk. You can close your account at any time by writing to info@aurahimalaya.org.
Licence and content ownership
We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to use the Pranam app for your own non-commercial listening. All recordings, compositions, artwork, text, software and trade marks in the Service remain the property of Aura Himalaya or our licensors and performing artists.
You may not:
- Copy, download outside the app, rip, re-upload or redistribute any audio.
- Sample, remix or use the recordings in any other work, commercial or otherwise.
- Play the content publicly, in a business, class, event or broadcast, without our written permission.
- Remove or obscure any copyright or attribution notice.
If you would like a licence for teaching, therapy, retreat or commercial use, contact info@aurahimalaya.org and we will be glad to discuss it.
Subscriptions and in-app purchases
Some features and tracks require a paid subscription. Subscriptions are sold and billed through the Apple App Store or Google Play, under the account you used to install the app. The price, billing period and any introductory offer are shown to you before you confirm the purchase.
- Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the period ends.
- Your store account is charged for renewal at the price shown at purchase, unless we have told you of a price change in advance.
- Cancel at any time in your Apple or Google account settings; cancelling stops future renewals and you keep access until the current period ends.
- Free trials convert to a paid subscription unless cancelled before the trial ends. Only one trial per person, unless we say otherwise.
- Refunds are handled by Apple or Google under their own policies. We cannot issue refunds for store purchases directly, but write to us and we will help where we can.
We may change subscription prices or the contents of a plan. Changes never apply to a period you have already paid for, and we will tell you before a renewal at a new price.
Promotional and complimentary access
We sometimes grant free or discounted access for trials, gifts, reviews, partnerships or customer support. This access is discretionary, has no cash value, may be limited in time, and may be reduced or withdrawn at any time if it is misused or granted in error.
Emails from us
Service emails — sign-in links, password resets, receipts and important account notices — are part of the Service and cannot be switched off while you hold an account. Launch announcements and other marketing emails are sent only if you asked for them, and every one carries an unsubscribe link. Unsubscribing from marketing does not close your account.
Acceptable use
When using the Service, you agree not to:
- Reverse engineer, decompile or attempt to extract the source code or audio assets.
- Scrape, crawl or use bots or automated tools against the app or our API except as our developer documentation allows.
- Circumvent paywalls, entitlement checks, rate limits or any security measure.
- Share API keys, or use them in a way that disrupts the Service for others.
- Upload malware, attempt to gain unauthorised access, or interfere with our infrastructure.
- Use the Service for anything unlawful, or in breach of any applicable export or sanctions rules.
Wellness disclaimer
Pranam offers music, ragas and guided breathing for relaxation, focus and sleep. It is not medical advice and is not a diagnosis, treatment or substitute for care from a qualified health professional.
If you have a heart, respiratory, psychiatric or neurological condition, are pregnant, or are recovering from injury or surgery, speak to your doctor before following any breathing exercise. Stop immediately if you feel dizzy, faint or unwell. Never use sleep content, guided breathing or eyes-closed sessions while driving, cycling, operating machinery or doing anything that needs your attention.
Third-party services and app stores
Your use of the app is also subject to the terms of the app store you downloaded it from and of any third-party sign-in provider you use, such as Google or Apple. Those companies are not parties to this agreement and are not responsible for the Service, but Apple is a third-party beneficiary of these terms and may enforce them against you for the iOS app.
Disclaimer of warranties
The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all implied warranties, including fitness for a particular purpose, merchantability and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any particular track or feature will always remain available.
Limitation of liability
To the fullest extent permitted by law, Aura Himalaya is not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill, arising from your use of the Service. Our total liability for any claim is limited to the greater of the amount you paid us in the twelve months before the claim, or USD 50.
Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud. Consumers keep all mandatory rights under their local law.
Indemnity
You agree to indemnify and hold Aura Himalaya harmless from any claim, loss or expense, including reasonable legal fees, arising from your misuse of the Service, your breach of these terms, or your infringement of anyone else's rights.
Termination and changes
You may stop using the Service at any time. We may suspend or end your access if you breach these terms or if we discontinue the Service, and we will give reasonable notice where we can. We may also change the Service or these terms; the date at the top shows the latest revision, and material changes will be notified to registered users. Sections on content ownership, disclaimers, liability and indemnity survive termination.
Governing law and contact
These terms are governed by the laws of Nepal, and the courts of Kathmandu, Nepal have exclusive jurisdiction, without affecting any mandatory protection available to you as a consumer in your country of residence.
